1. The regulatory context

Recent technological innovations have literally redesigned the digital advertising landscape. Previously, contracts involved a defined and limited number of actors: a publisher, an advertiser, a sales intermediary (media seller) and a purchasing intermediary (media buyer). The situation has, however, become much more complex with the emergence of a myriad of new players, modalities for the purchase or sale of real-time advertising inventories and very sophisticated offers.

These practices without technological or geographical boundaries continue to develop. It is therefore very complex for a large part of the actors in the value chain to comply with the Sapin Law that came into force on January 29, 1993, and is still the reference text on the subject, but whose interpretation in terms of digital advertising are all the more complex as it was enacted to regulate non-digital practices.


2. The advantages of education and training on the law Sapin

The Sapin Law is nonetheless a public order law with significant criminal penalties in case of breach. It is applicable to every company, regardless of nationality, as soon as a certain number of conditions are met, starting with the broadcast of a majority of the advertising inventory on French territory. The application of an “old” law with few articles from which stem numerous obligations, as well as the decree of enforcement which entered into force in 2018 and whose scope is still the subject of divergent interpretations make compliance complex for the entire digital advertising industry and especially for start-ups.

The process step by step

During this first call, we will present the service offered by the firm, we’ll specify the first documents to send us for the smooth running of the service, and we’ll set a cost estimation that will be confirmed in writing as soon as possible.

We will also take advantage to respond to any eventual questions you may have about the service.

Following the first call, we will send you a quote, a link to make the payment and a letter of commitment that you must return signed by email. Upon receipt of the letter of commitment and confirmation of payment, we will start processing your request. To do this, a second call of 30 minutes will allow us to identify the specific needs of your organisation to deliver a tailor-made service. After a time period depending on your needs, we will get back to you via email for the execution of the service. You will also receive a link simultaneously which will enable you book an appointment for a third call of 15 minutes during which we will present you the result of our work in a detailed way and will submit you personalised recommendations.
