1. What is a media selling agreement ?
In accordance with the Sapin law n ° 93-122 dated January 29, 1993, a media selling agreement establishes the legal contractual framework between a publisher (regardless of the advertising medium concerned) and an advertising agency (as soon as you set about to purchase ad inventory, you are considered an agency).
2. Technological advancements and media selling agreements
The Sapin Law has established a general principle of transparency by strictly defining the obligations of the parties. However, the interpretation of this regulation has not necessarily evolved to accompany technological changes, including the emergence of programmatic advertising, which is not without impact on your ad agency agreements.
It is impossible to predict or even list changes related to the arrival of new technologies, new offers and new players, and the new legal obligations that flow from them. Such constant upheaval requires a lot of experience and creativity to assist you in drafting your contracts.
