1. What is a Media-Buying Agreement ? What regulatory issues are at stake for such contracts ?
Media buyers (media agency) are companies authorised to buy advertising space in the name and on behalf of advertisers, through advertising purchasing agreements. These agencies were particularly affected by the Sapin Law No. 93-122 of 29 January 1993, imposing various obligations on them and placing them under increased surveillance. Such developments have obviously affected their contractual relations, which are now much more regulated.
Like with several media players, the arrival of digital advertising has enriched these existing obligations and rendered them more complex. Past and future technological developments create a constantly evolving legal framework, which requires a lot of experience and creativity to help you draft your contracts.
