1. What are legal notices ?
Legal notices refer to the mandatory information that must appear on any communication platform. The legal notices of a connected platform (website, application …) are meant to ensure a certain transparency as to the identity of the person, natural or legal, who issues the information and to meet the regulatory obligations specific to content or territoriality etc.
2. Why set legal notices ?
Every publisher of a connected platform (whether offering paid services market services or not) must, subject to substantial criminal sanctions (up to 1 year imprisonment and 75 000 € fine in France ), display a number of mandatory legal notices. These vary depending on the form of the organisation, the nature of the services, the territoriality. In the UK like in many jurisdictions, the Companies Act 2006 imposes obligations on websites to display at all times the complete identity of its publisher in order to be in compliance. Failure of which businesses can find themselves facing a fine not exceeding level 3 of the standard scale.
The General Data Protection Regulation (GDPR) has added a significant number of additional specific terms to be included in legal notices in order to provide Internet users with greater transparency and greater control over the processing of their personal data. Such terms with respect to personal data protection should notably inform the user about all processing done by your organisation and your entire ecosystem on the data collected through your platform.
